These Terms and Conditions ("Terms") govern your access to and use of the Koja kojon mobile application, website, virtual challenges, products, and related services (collectively, the "Service").

The Service is operated by:

Kondri, MB
Company code: 307438050
Registered office: Jaunimo g. 7-4, Raudondvario k., LT-82213 Radviliškio r., Lithuania

In these Terms, "Koja kojon", "we", "us", and "our" refer to Kondri, MB.

By creating an account or using the Service, you agree to these Terms.

Nothing in these Terms limits any rights granted to you under mandatory consumer protection law.

1. About Koja kojon

Koja kojon provides virtual walking and activity challenges.

You undertake physical activity in the real world wherever you choose. Eligible activity recorded or entered into the App is converted into progress along a virtual challenge route.

You are not expected or instructed to physically follow the route displayed in a challenge.

Depending on the challenge and features available, the Service may allow you to:

Challenge routes, maps, checkpoint locations, and related content are provided for virtual, educational, and entertainment purposes. They are not navigation instructions and should not be relied upon for real-world route planning, road safety, hiking, travel, or emergencies.

2. Eligibility and Minors

You must be at least 14 years old to create and manage your own Koja kojon account.

If you are under 18, you may use the Service and make purchases only to the extent permitted by applicable law and, where required, with the involvement or permission of a parent or legal guardian.

Third-party services connected to Koja kojon may have different age requirements.

If we become aware that an account has been created in breach of applicable age requirements, we may take reasonable steps to restrict or remove that account.

3. Your Account

Koja kojon uses passwordless authentication.

Depending on the options available to you, you may sign in using:

You agree to provide accurate information and to keep access to your email account and devices secure.

You must not create an account using another person's identity without permission.

You are responsible for activity performed through your account to the extent permitted by applicable law.

You may request deletion of your account at any time using the functionality provided in the App or through the methods described in our Privacy Policy.

4. Challenge Progress

Challenge progress may be based on:

Supported activity types currently include walking, running, cycling, and step-based activity where available.

You are responsible for ensuring that manually entered activities are reasonably accurate.

Data received from health or fitness platforms can occasionally be incomplete, duplicated, delayed, or inaccurate.

We may make reasonable corrections where necessary to prevent duplicated activity, obvious technical errors, fraud, or manipulation and to maintain the integrity of challenge progress.

Virtual progress, checkpoints, achievements, virtual medals, and other virtual challenge elements have no monetary value and cannot be redeemed or exchanged for cash.

5. Health and Fitness Integrations

You may choose to connect Koja kojon to compatible health or activity services.

The App currently supports activity synchronisation through device health platforms where available.

Connection to these services is optional. Where manual activity entry is available, you can use Koja kojon without granting health-data access.

Koja kojon requests only the permissions necessary for challenge progress.

We do not use your health or activity information for advertising.

The specific integrations available may vary by device, operating system, country, and version of the App.

Third-party platforms are independently operated and are also subject to their own terms and privacy policies.

More information about the activity information Koja kojon processes is provided in our Privacy Policy.

6. Free Access and Paid Challenges

Some challenges or parts of challenges may be available free of charge or as a limited trial.

A free trial may allow progress only up to a specified distance or checkpoint.

Additional access may require a one-time purchase.

Unless expressly stated otherwise during purchase:

The conditions and limitations applicable to a challenge will be displayed before purchase or participation where relevant.

7. Prices and Payment

Prices are displayed before you confirm a purchase.

The total price, including applicable taxes and delivery charges where relevant, will be displayed before payment.

We may change prices for future purchases. Price changes do not affect purchases that have already been completed.

Payments are currently processed using a third-party payment provider.

Koja kojon does not receive or store your full payment card number.

We may receive transaction information such as:

Payment options may change in the future.

8. Digital Products and Challenge Access

Digital purchases may include:

Any technical requirements or significant restrictions relevant to the digital product will be disclosed before purchase where required.

Where you have a statutory right to withdraw from a digital purchase, that right applies in accordance with applicable consumer law.

If you expressly request that digital content be supplied immediately during the statutory withdrawal period, we may separately ask you to acknowledge that beginning supply may result in the loss of your statutory withdrawal right.

Where such consent and acknowledgement are legally required, they will be requested separately during checkout. Acceptance of these Terms alone does not constitute that consent.

If the required consent or acknowledgement has not been obtained, your statutory rights remain unaffected.

9. Gifts

Certain products or challenges may be purchased as gifts.

Gift purchases may generate a unique claim code.

Gift codes:

The purchaser is responsible for sharing a gift code with the intended recipient.

We are not responsible for a claim code voluntarily shared with or redeemed by the wrong person unless the problem was caused by us.

Where reasonably possible, contact us promptly if a gift code has been compromised.

10. Physical Medals and Products

Physical products may include medals and bundles containing a physical medal.

The characteristics and price of each product will be shown before purchase.

Product photographs and digital previews are intended to represent products as accurately as reasonably possible.

Minor differences in appearance, colour, texture, dimensions, finish, packaging, or screen representation may occur as part of normal manufacturing or display variation.

This does not affect your statutory rights if a product is defective or does not conform to the contract.

11. Shipping

Physical products are currently delivered through supported parcel-locker services in:

Lithuania, Latvia, and Estonia.

Available carriers and delivery locations are displayed during checkout.

You must provide accurate delivery information, including your name, phone number, selected country, carrier, and parcel locker.

Delivery charges will be shown before payment.

Any estimated delivery period shown during checkout is an estimate unless expressly agreed otherwise.

If no different delivery period has been agreed, we will deliver within the period required by applicable consumer law.

Unless you independently arrange a carrier that was not offered by us, risk of loss or damage to a physical product remains with us until you or a person designated by you receives the product.

We are not responsible for delivery problems caused solely by materially inaccurate delivery information supplied by you, to the extent permitted by law.

If a parcel handled by a carrier selected or offered by Koja kojon is lost or damaged before delivery, please contact us rather than relying solely on the carrier.

12. EU Right of Withdrawal for Physical Goods

If you are an EU or EEA consumer and applicable law provides a right of withdrawal, you normally have 14 days from receiving a physical product to withdraw from the purchase without giving a reason.

To exercise this right, you must clearly inform us before the withdrawal period expires.

You may contact:

info@kojakojon.app

After notifying us of your withdrawal, you must return the product without undue delay and within the legally applicable period.

Unless we agree otherwise or applicable law requires otherwise, you are responsible for the direct cost of returning a non-defective product where you were informed of this before purchase.

Following a valid withdrawal, we will refund the amount required by applicable law, including the cost of the least expensive standard delivery method offered for the original order.

We may withhold the refund until we receive the returned goods or evidence that you have sent them back, where permitted by law.

You are responsible for any reduction in value caused by handling beyond what would reasonably be necessary to inspect the nature and characteristics of the product.

Personalised Goods

The statutory right of withdrawal may not apply to goods made specifically to your instructions or clearly personalised where the applicable legal exception applies.

A standard Koja kojon challenge medal is not considered personalised merely because you completed the associated challenge.

Any personalisation that affects withdrawal rights will be clearly disclosed before purchase.

This exception does not affect your rights if the product is faulty, damaged, or otherwise does not conform to the contract.

13. Defective Products and Statutory Guarantees

Physical products and applicable digital products or services are covered by mandatory statutory consumer rights.

If a physical product is faulty, damaged, not as described, or otherwise does not conform to the contract, you may be entitled to remedies provided by applicable law, which can include repair, replacement, price reduction, termination, or refund.

Similar statutory conformity rights may apply to digital content and digital services.

These rights are separate from the 14-day right of withdrawal.

Nothing in these Terms reduces any mandatory legal guarantee or statutory remedy.

Contact info@kojakojon.app if you believe a product or paid service does not conform to the contract.

14. Health and Safety

Koja kojon encourages physical activity, but you decide:

Koja kojon does not assess whether a particular activity, route, distance, weather condition, or level of exertion is safe for you.

You are responsible for taking reasonable care of your health and safety.

You should comply with road rules, access restrictions, weather warnings, local laws, and reasonable safety precautions.

Do not use the App in a way that distracts you while driving, cycling, crossing roads, or performing another activity requiring your full attention.

Koja kojon is not a medical device and does not provide medical diagnosis, treatment, or medical advice.

If you have concerns about your ability to exercise safely, seek appropriate medical advice.

Nothing in these Terms excludes liability that cannot legally be excluded.

15. Maps and Routes

Maps displayed in Koja kojon represent virtual challenge routes.

They are not intended to show the user's actual location or actual walking, running, or cycling route.

Map content may be supplied partly through third-party mapping services.

Maps, geographical information, distances, and checkpoint locations may contain minor inaccuracies or change over time.

Do not rely on Koja kojon maps for real-world navigation or safety-critical decisions.

16. Intellectual Property

Koja kojon and its content are owned by or licensed to Kondri, MB and are protected by applicable intellectual property laws.

This includes, where applicable:

We grant you a limited, personal, non-exclusive, non-transferable right to use the Service for personal, non-commercial purposes in accordance with these Terms.

You may share your own Koja kojon achievements, generated certificates, or screenshots for ordinary personal and social-media use.

You may not reproduce, sell, commercially exploit, systematically extract, distribute, or create derivative commercial products from Koja kojon content without permission, except where applicable law permits otherwise.

17. Acceptable Use

You must not use Koja kojon to:

We may take reasonable measures to investigate and respond to fraud, misuse, technical abuse, or security risks.

18. Third-Party Services

Koja kojon relies on third-party services for functions such as:

Their availability and operation may occasionally affect the Service.

Their involvement does not remove any legal responsibility that applicable consumer law places on us.

Use of certain third-party services may also be governed by their own terms.

19. Availability and Updates

We aim to provide a reliable Service but cannot guarantee uninterrupted availability.

The App may occasionally be unavailable because of:

We may provide updates to improve functionality, compatibility, security, or legal compliance.

Where applicable law requires us to provide updates necessary to maintain conformity of paid digital content or services, we will do so as required.

20. Changes to the Service

We may reasonably modify the Service to:

Where applicable consumer law limits our ability to modify an ongoing paid digital service, those mandatory rules will apply.

Where a material change negatively affects a paid digital service, we will provide any notice or remedies required by applicable law.

21. Account Suspension and Termination

You may stop using the Service at any time.

You may also request account deletion.

We may restrict or terminate access where reasonably necessary because of:

Where appropriate and reasonably possible, we will provide notice before permanent restriction unless immediate action is necessary.

Any restriction affecting a paid service remains subject to your mandatory consumer rights.

22. Account Deletion

Deleting your Koja kojon account removes your account and associated Service data from our primary systems as described in the Privacy Policy.

Certain information may need to be retained where required for accounting, taxation, fraud prevention, legal claims, or another legal obligation.

Account deletion does not itself:

Purchase-related requests should be submitted separately to info@kojakojon.app.

23. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing excludes or limits mandatory consumer rights or liability that cannot legally be excluded.

To the extent permitted by applicable law, we are not responsible for losses caused solely by:

The Service is intended primarily for personal consumer use.

To the extent permitted by law, we are not responsible for business losses resulting from use of a personal Koja kojon account for commercial purposes.

24. Changes to These Terms

We may update these Terms where reasonably necessary because of changes to:

The current version and its last-updated date will be available through the App or website.

If a change materially affects your rights or obligations, we will provide reasonable advance notice where required.

Where applicable law requires consent to a change, we will obtain that consent.

25. Consumer Complaints

We will respond to consumer complaints within the period required by applicable law.

For Lithuanian consumer complaints, a reasoned response will be provided no later than 14 calendar days after receipt where required by law.

If we cannot resolve a consumer dispute directly, eligible consumers may submit the matter for out-of-court dispute resolution.

In Lithuania, disputes falling within its competence may be submitted to:

Consumers may also use Lithuania's Consumer Rights Information System (VTIS).

26. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Lithuania.

If you are a consumer habitually resident in another country, this choice of law does not deprive you of mandatory consumer protections that would otherwise apply to you.

Disputes will be handled by courts having jurisdiction under applicable law.

Nothing in these Terms restricts mandatory rights that EU consumers may have concerning jurisdiction or access to courts in their country of residence.

27. Severability

If a provision of these Terms is found invalid or unenforceable, it will apply only to the extent legally permissible.

The remaining provisions will continue to apply.
